Terms of Service

These Terms of Service govern the provision of services by Cloud365 Australia Pty Limited ("Cloud365") to its customers. By engaging Cloud365 services, you agree to these terms.
Services
Cloud365 provides managed cloud hosting, infrastructure design, technical support and related services as agreed in your service proposal. The scope and pricing of services are defined in the proposal accepted by you.
Payment
Services are billed monthly in Australian dollars at the fixed price agreed in your proposal. Invoices are issued at the start of each billing period. Payment is due within 14 days of invoice. We accept VISA, Mastercard and PayPal.
Service availability
Cloud365 targets high availability across all managed services. Where a service interruption is caused by a fault within Cloud365's infrastructure or control, we will provide credit or refund in accordance with any applicable SLA in your service agreement.
Your responsibilities
You are responsible for the lawful use of services, for ensuring your applications comply with applicable law, and for providing accurate information necessary for service delivery. You must not use Cloud365 services in violation of our Acceptable Use Policy.
Termination
Either party may terminate services with 30 days written notice. Cloud365 may suspend or terminate services immediately in cases of non-payment (after reasonable notice) or breach of the Acceptable Use Policy.
Liability
To the extent permitted by Australian law, Cloud365's liability is limited to the monthly service charge for the affected service in the month the issue occurred.
Governing law
These terms are governed by the laws of Victoria, Australia. Disputes are subject to the jurisdiction of Victorian courts.
